Introduction

General terms and conditions of use for the 4Suits.net online shop

  1. Introduction

(a) The seller specialises in jewellery and accessories offered through the 4Suits.net online shop.

These general terms and conditions of use apply to all purchases of products and services made by the buyer and provided by the seller, unless otherwise stated.

(b) Within the scope of these general terms and conditions of use, an end consumer is defined as a private individual who enters into a transaction with the seller exclusively for private and personal purposes, and for no other business or freelance activity. Differently, for the purposes of these general terms and conditions of use, an enterprise is defined as a natural person, a legal entity or a partnership that enters into a transaction with the seller as part of its commercial or freelance activity.

(c) Any deviation, contradiction or supplementation of any of the following general terms and conditions of use shall render this contract invalid, unless otherwise agreed between the parties, i.e. the buyer and the seller.

(d) The seller reserves the right to change these general terms and conditions of use at any time by amending this page. The updated terms shall supersede and take precedence over previous versions of the general terms and conditions of use of the site.

(e) Use of the site (including accessing, browsing or registering for its use) implies unconditional acceptance of these general terms and conditions of use.


  1. Conclusion of the contract

(a) The Seller's offer may be subject to change at any time, without prior notice and at the Seller's sole discretion. Although the vendor makes every effort to ensure that the colours, design and style of the 4 SUITS products as shown in photographs on the site correspond to a representation in conformity with the original product, certain variations may always occur, as a result of technical limitations in the reproduction of colours on computer screens and in particular due to the handcrafted nature of the products. 

For this reason, under no circumstances can 4 SUITS be held liable for any errors or inaccuracies in the photographs or graphic representations of the products as shown on the site. If you have any questions about the products, you can contact our customer service department at store@4suits.net.

(b) Confirmation of the order implies acceptance of the general terms and conditions in their entirety. All orders can be placed online, on the 4Suits.net website. The transaction carried out constitutes a binding agreement for the fulfilment of a purchase contract. By clicking on the "submit order" button during the online purchase process on the 4Suits.net website, the purchaser is entering into a binding purchase agreement, regarding the products in his shopping cart. The order cannot be changed or cancelled, except under the conditions set out in the general terms and conditions of use.

(c) The purchaser shall be informed by e-mail as soon as the order has been received. Please note: receipt of this first e-mail does not imply that the agreement has been formalised. The agreement shall be deemed to be formalised when the order confirmation is sent or the purchased products are prepared for delivery.


(d) The release of the purchased goods for shipment by the seller also constitutes acceptance of the order. The seller reserves the right to refuse orders without being obliged to provide any reasons.

(e) Fulfillment of the order is accepted with the proviso that in the event of improper delivery or non-delivery of the goods by the suppliers, the seller reserves the right not to deliver the products or to deliver only part of the purchase.

This shall only apply in the event that the seller has correctly concluded a supply transaction and has not been supplied by its supplier through no fault of its own.

The seller undertakes to make every reasonable effort to procure the products sold. If the products cannot be procured, 4 SUITS will promptly refund the payment received. If the products purchased are not available, or are only available in part, the buyer will be informed immediately.

(f) Once the contract has been signed - and if the products have been ordered electronically - the text of the contract, together with the legally binding general terms and conditions, will be sent to the customer by e-mail. The data recorded by the website establishes proof of all transactions carried out by 4 SUITS and its customers. In the event of a dispute between 4 SUITS and one of its purchasers regarding a transaction carried out on the website, the data recorded by 4 SUITS shall be considered incontrovertible proof of the content of the transaction.

  1. Retention of title and withdrawal

(a) With regard to end consumers (private individuals): the ordered goods remain the property of the seller until full payment for them. As far as businesses are concerned: the seller retains ownership of the products until full payment of all claims arising from the current business relationship.

(b) In the event of a breach of contract on the part of the buyer (due, in particular, to default in payment, falsification of information, receivership proceedings, insolvency of assets, or bankruptcy proceedings), the seller reserves the right to withdraw from the contract and demand the return of the goods at any time if the buyer has not provided or has only partially provided payment for the products ordered.

  1. Prices and Payment

(a) Prices are subject to change. The price calculation is determined by the list price and any discounts, plus value-added tax (VAT), as determined by the seller.

(b) The purchaser is only entitled to compensation if his claim has been legally recognised, acknowledged by the seller, or is undisputed. The purchaser may exercise its right of retention if the dispute arises from the same contractual relationship.

(c) In the event of pricing errors, or erroneous product information, due to typographical or system errors, 4 SUITS reserves the right to cancel orders sent with erroneous information without further obligation to the customer even after receipt of an order confirmation or dispatch notice.

5.Payment options and shipping costs

Buyers may make payments with all major credit cards including Visa, Mastercard and American Express. Advance payment, bank transfer and PayPal are also accepted. The seller reserves the right to exclude specific payment methods.

  1. Shipping

(a) Unless otherwise specified, all products are inclusive of VAT (where applicable) and do not include shipping costs. Please note that customs duties should also be taken into account and are the responsibility of the buyer.

(b) The seller reserves the right, if circumstances require, to deliver the purchased goods in several separate deliveries. In such a case, the seller shall endeavour to protect the interests of the buyer, who shall not incur any additional costs.

  1. Transfer of risk

(a) The customer must, on his own responsibility, check the product(s) shipped at the time of delivery for correspondence with what was ordered. If any discrepancies are found, the customer must not accept the package and must describe the defects found (e.g. signs of tampering, damage to the product, missing products or parts, or products other than those ordered and/or indicated in the shipping document) in writing directly on the document brought by the carrier. Please note that the risk of accidental loss or accidental damage of the purchased item - even during the transaction stages - is transferred to the customer at the time the item is delivered.

(b) After the order process, including the product summary page and the payment page, the price of the products indicated in the confirmation email you will receive does not include 'customs duties' (if due) applied on exports and imports into your country. Placing an order implies unconditional acceptance of the terms stating that all additional charges are the responsibility of the customer.


  1. Consumer's right of cancellation

(a) Time limits for cancellation

(i) If the seller cannot meet the preliminary delivery date, he shall inform the buyer thereof in good time. In the event of problems with normal business procedures on the part of the seller for which he is not responsible, e.g. in the event of interruptions on the part of suppliers, the delivery time shall be extended in accordance with the delays due to the interruptions. The buyer has the right to withdraw from the contract, without stating reasons, by returning the purchased products and submitting the return form to the seller within 30 days of receipt of the products, if the conditions of the right of withdrawal are fulfilled. In any event, exceptions apply to products that have been manufactured according to the customer's wishes or that have been adapted to the buyer's specific needs, such as customisation and engraving.

(ii) The period for exercising the right of withdrawal shall commence upon receipt by the seller of the buyer's written instructions to cancel his order (in the case of an order delivered in several separate shipments, the period shall commence with the delivery of the first part of the order) and not before the seller has acknowledged his responsibilities and other legal obligations. In order for the return to be carried out without further delay, the request and the products must be sent within the given time period.

(b) Consequences of termination:

(i) In order to properly complete the procedures under the right of withdrawal, both parties must return to each other the goods purchased and the sums of money involved in the transaction. The same applies to any benefits gained from the exchange (e.g. any interest). If the buyer is unable to return the purchased goods, or can only return a part of them, or returns them in a damaged condition, he shall be obliged to compensate the seller for the full value of the purchased goods, even if he has used them contrary to the principle of good faith, or for personal profit.

No compensation shall be claimed if the goods have been used for the purpose for which they were made, i.e. by not using the goods as if they were property and by avoiding anything that diminishes their value.

(ii) The cost of returning the purchased goods will be borne by the buyer. The seller cannot accept the return of products if the parcel is without postage or with insufficient postage.

The seller must meet its obligations to refund payments within 30 days of the request to make use of the right of withdrawal, or within 30 days of the products being returned. The seller reserves the right to determine at its own discretion whether products returned to 4 SUITS are in their original condition. The seller shall not be responsible or liable for any loss, late delivery or delivery to the wrong recipient if the buyer returns the purchase by courier or postal shipment. The buyer bears all risks of the shipping method chosen for the return of the order.

  1. Returns

(a) If a purchaser is a natural person, who has placed a private order without intentions attributable to a commercial purpose or entrepreneurial activity, then he is considered to be an end consumer and for this reason can avail himself of the right of withdrawal as specified below.

By exercising the right of withdrawal in accordance with Paragraph 8 of these General Terms and Conditions, the purchaser is obliged to return the purchased products in their original condition and packaging.

  1. Warranty

(a) The products sold may vary slightly from the products as shown in the online shop on the Internet and the buyer agrees to check the information of each product carefully before confirming his order.

(b) If the customer is an end consumer, he may request how the seller is to perform its warranty obligations, i.e. whether by repair or replacement of the goods. The seller is entitled to reject the method chosen by the purchaser only if that method involves unreasonable costs and if the other method does not entail excessive disadvantages for the purchaser.

(c) If fulfilment of the warranty obligations should fail, the purchaser may demand a reduction of payment or termination of the contract (withdrawal). In case of minor defects, the purchaser shall not be entitled to rescission of the contract, taking into account the mutual interests. In all claim proceedings against the other party, the purchaser may choose compensation for damages or compensation for unnecessary expenses that it reasonably incurred upon receipt of the goods. If the purchaser chooses damages instead of performance, the limitations of liability pursuant to Section 11 shall apply, 

(d) The guarantee period for products purchased by end consumers is 2 years from delivery. This period shall not apply if the buyer is intentionally or grossly negligent in taking care of the purchased products. 

(e) The seller does not provide any further guarantees to the buyer unless expressly agreed. This does not affect the manufacturer's guarantee.

  1. Limitation of liability

(a) In the event of minor breaches of its obligations, the seller's liability shall be limited to the direct, typical and foreseeable average damage, depending on the type of product concerned. This shall also apply in the case of minor breaches by the legal representative or sales agents. The seller is not liable for minor, non-essential breaches of contract due to negligence. Conversely, it is liable for breach of the buyer's essential contractual legal positions. The buyer's essential contractual legal positions are those guaranteed by the signed contract, according to its content and ultimate purpose. The seller is also liable for the breach of obligations whose performance is necessary for the proper execution of the contract, and in whose observance the parties regularly agree.
